赤信号直進のバイクと衝突 車のドライバーに無罪判決 福岡地裁

交差点を右折しようとした車が対向車線を赤信号で直進してきたバイクと衝突した事故で、車のドライバーが罪に問われるかが争われた裁判で、福岡地方裁判所は「赤信号で交差点に進入してくるバイクまで予測して安全を確認すべき注意義務はない」などとして、過失運転傷害などの罪に問われたドライバーに無罪を言い渡しました。
おととし10月、福岡県古賀市にある片側3車線の国道の交差点で、乗用車が右折しようとした際、対向車線を赤信号で直進してきたバイクと衝突し、乗用車を運転していた市内のナイジェリア国籍の50代の男性がバイクの運転手にけがをさせたとして過失運転傷害などの罪に問われました。
検察は、バイクが赤信号で交差点に進入していたことを把握しないまま男性を起訴しましたが、男性側の指摘を受けて補充捜査を行った結果、バイク側が赤信号を直進したことが明らかになり、起訴内容を変更していました。
27日の判決で福岡地方裁判所の今泉裕登裁判長は「車を運転していた男性は対面の信号が赤に変わり、もはや赤信号に従わないで交差点に進入してくる車両はないと信頼して右折した。赤信号で停止している他の車両を追い抜いたうえで交差点に進入してくるバイクまで予測して安全を確認すべき注意義務はない」などと指摘し、無罪を言い渡しました。
判決について男性は「捜査した警察は私の言ったことを信じてくれませんでした。もともと思っていたとおりの判決が出てうれしいです」と話しました。

今回の事故は、信号優先での判決でしっくりします。赤信号を無視する車両を考慮していると、そもそも信号の意味がなくなりますからね。白黒がきっちりしているアメリカでも、信号無視をした方が１００％のLiabilityとみなされます。
自分がもし当事者だったらという立場になって考えてみると、車の方は「ふざけんじゃねぇよ」って気分になりますし、バイクの方は「あー、やっちまったー」って気分になります。
それが全てな気がしますね〜。

自転車で考えると､右折した車の先には､横断歩道が有りますから、車の脇から自転車が出て来て､横断歩道より道路側を走って来たらと考えると､車の方も､ちょっと悪い気もしますねー😞❓
まぁ、結局は、バイクが信号無視で行ってるので、もちろん悪いんですが、9対1が､私の思う所ですね😊✋
自動車側は青、バイク側が赤信号なので、迷わずバイク側が100％悪いでしょうね。車側の運転手が外国籍の方だったからか検察側の悪意を感じます。
夏になると、他県ナンバーのバイクがすり抜けまくっているのを見て、「危ねーな」と思います。田舎のドライバーは、すり抜けに免疫力がないので、怪我をしたり、○ぬのは勝手ですが、誰かに必ず迷惑をかけるんですよね。
まささんが試乗で走ってる奥多摩も、ハミ禁なのに平気で追い越してくライダーは、自爆して二度とバイクに乗らないで下さい。と思います。
妥当な判決かと想います。他人に危害や迷惑を与えかねないバイクに乗っている自分自身への戒めにもなりました。
赤信号は止まれ。青信号は進んでよい。こんな簡単な事を分からない者は乗り物に乗る資格ないですね。車も前方不注意ありますが過失割合は8:2辺りでバイクが悪くなるでしょう。たぶん。
信号無視vs前方不注意の過失割合が10：0にならない道交法がおかしいんだよなー
もらい事故にもかかわらず「あなたは前方不注意だから」ってことで過失割合が9：1になって納得できない人って結構いるんじゃない？
交差点内の事故は､保険の過失割合で明確に決まっていて、今回の事故は､100%信号無視のバイクが悪く成ります。‼️バイクが黄色信号で直進して来ても70%バイク側が悪く成ります。バイクも車もドライブレコーダーを装着していれば当事者同士で揉める事もなく成ると思います。‼️
たとえ自転車であれ子供であれ信号無視は違法です。が可能性が0ではないので車も注意しましょう。と言う事だと思います。人間社会のルールは社会性を維持していくためのものです。それを逸脱する事は戦争やテロと言う事ではないですか！
これ一昔前だったら変な判決が出てたかも知れないですが、今は自転車にも歩行者にも道交法を守る義務が求められますからマトモな時代になったと思います。自分も信号で先頭になった時は必ず左右見ますね。あと右左折での横断歩道でも自転車が突っ込んでくるかもしれないので斜め後方確認はします。

自分もバイクが問題ある行動であると感じます。しかしながらまささんのおっしゃっている煮えきれなさも感じます。
ルールとしてバイクが悪いは間違えないと思いますが、今の公道はあまりに事故を起こさないための行動が欠けた車、バイクが多いと思います。まささんのように、ルール上どっちがということ関係なく、それぞれが十分な確認、予測行動を行っていればぶつかる確率はかなり下がるわけで。

まささんは、交通弱者のところで違和感があるのだと聞いてて思いました。
信号無視したのがバイクでなく車だったらどうでしょう？例えばダンプだったら？あまり違和感なくダンプが悪いと腑に落ちるのでないでしょうか？
今度は逆に、ナイジェリア人が乗ってたのがバイクだったら？
自分はそんなふうに考え、やはり信号無視のバイクが悪いとの結論に達しました。

法のために人の社会があるのか、人の社会のために法があるのか。法律解釈が余裕を持たせてあるのは細かい案件にコミットさせるために余白をとってあるんです。きっちり線引きしてしまう今の世の中ですが、ダメ言われてないことはやってもいい、やってはいけないと明記してあること以外はやってもいいという他人に厳しく自分に甘い勝手な判断が招いた事故だとおもいますよ。バイクは自業自得だし、いい歳こいてバカなことをした死ななくてよかったと猛省するべきです。あと現場警官も調書が違うんだったらきちんと訂正しないと無能すぎますね。こういう無能警官が信頼を失墜させています。
交差点左右侵入確認、左右巻き込み確認はとても大切ですね、自分も常に確認しています。
事実に基づいた判決が出て、まずは良かったです。事故を起こせば、どんなに自分が悪くなかったとしても、時間も労力も金銭面でも得はありません。だろう運転ではなく、かもしれない運転を心掛けたいと思いました。
赤信号の意味無くなるよねぇ😱恐ろしい。
35年前、自動車免許の教習中に教官から言われた言葉
『青信号は進めでは無く、（安全を確認して）「進む事が出来る」だからね。』
というのを未だに覚えています。
なら 赤信号は？ という事に尽きると思います。
スリ抜けせざるを得ない心境って有りますね、何十㌔の渋滞走ると。だけど、直ぐ止まれる速度でないと危ないから、クルマの流れの速度＋１０km/h以内ですョ。→止まってる車列のスリ抜けなら１０km/h以内→右直事故に成りえません。バイクが悪いですね♡。
